Iowa Judge Michael Hupper Thursday, July 1th, 2010 Judge Michael Hupper is inducted into the Hall of Shame for his decision to strike down Iowa’s abortion law banning a woman from obtaining an abortion once a fetus’ heartbeat is detected, saying it violated the state’s constitution. Abortion at any stage is evil and is a murder of the baby. But, even for the man-on-the-street to abort a baby with a beating heart should be a no-brainer. Of course, the abortion industry does not care about the baby and judges like Hupper give then the false justification to continue their blood-thirsty trade. Fox News reports: Judge Michael Huppert wrote that the measure was counter to both the due process and equal protection provisions of the Iowa Constitution as not being narrowly tailored to serve the compelling state interest of promoting potential life. Huppert also cited several cases in federal court, including decisions in 2015 and 2016 in the St. Louis-based 8th U.S. Circuit Court of Appeals, indicating that such laws were unconstitutional. Fetal heartbeats can be detected as early as six weeks into a pregnancy, making the Iowa law the most restrictive anti-abortion measure in the U.S. I am incredibly disappointed in today’s court ruling, because I believe that if death is determined when a heart stops beating, then a beating heart indicates life, said Iowa Gov. Kim Reynolds, who signed the bill into law in May. Iowa Republican Rep. Sandy Salmon, the main sponsor of the bill in the House, was disappointed the judge ended the case before it could be tried before a jury. Matthew Destry, Broward Circuit Judge Thursday, July 1th, 2010 Broward Circuit Judge Matthew Destry is inducted into the Hall of Shame for sentencing Herbert Smith to a total of 60 years in prison for a suspended driver’s license. Mr. Smith was on probation for several felonies, but he was not charge for any felony. Thus, the 60 years was for a suspended license while on probation. This stunned everyone including the prosecutor. Petitions were circulated to have the judge removed for such draconian sentencing. Allegations is the the judge did this mostly with black defendants. Here is a report from the Miami Sun Sentinel. The judge did suspend the sentence after pressure from the petition. Smith’s release is conditional. If Smith violates those conditions the 60 year sentence will be reinstated. That means that Smith still has a 60 year sentence over his head because he was driving with a suspended license. Justice S. Ford Clements, Superior Court in Toronto Thursday, July 1th, 2010 We induct Superior Court Justice S. Ford Clements, Toronto, Canada, into the Hall of Shame for shameless anti-Christian bigotry he spewed in Court. He told a ProLife defendant, Your God is wrong. This is another example of the growing anti-Christian sentiment overshadowing North America, that affects more than culture, but laws and judicial decisions. Beware! LifeSiteNews as the details: Judge who told pro-lifer Your God is wrong' comes under scrutiny by Tony Gosgnach TORONTO, September 20, 2012, (LifeSiteNews.com) The judge who told a pro-life activist Your God is wrong earlier this year came under scrutiny during an all-day appeal hearing at the Superior Court of Justice in Toronto on Wednesday. In a lengthy tirade, Justice S. Ford Clements had ripped Mary Wagner for what he saw as her cowardly attempt to speak to abortion-bound women inside the Bloor West Village Women's Clinic, an abortion facility. She was convicted on charges of mischief and failing to comply with probation orders. Although there had been no mention of God during the trial, Clements had said Wagner's views were no different than those of Islamic jihadists. Your own belief system¦that is what gets people into trouble and that is why, in Syria, people are dying in the streets, he said. Get a grip. She sure wouldn’t like it if someone was standing on her doorstep everyday pushing her around. Those comments demonstrated a reasonable belief of bias on Clements' part, defence lawyers Peter Boushy and Russell Browne said, as did his decision to sentence Wager to a six month sentence instead of a joint Crown-defence submission of 88 days in jail. Boushy and Browne also said the judge's questioning of Wagner as to whether she would obey the law, when she had chosen to exercise her right to remain silent, was improper. Boushy said while the determination of bias by a judge is a difficult and nuanced process, the legal principle is that justice must not only be done; a reasonable person must be able to realistically and practically conclude justice had been served impartially. Judges are held to stringent standards regarding bias, he said, adding it was troublesome that while Section 726 of the Criminal Code gives a judge no authority to engage a defendant in questioning during sentencing, Clements did just that. Even with the high threshold (for determining bias on the part of a judge), intuitively how could a reasonable person not come away without a reasonable apprehension of bias? Boushy asked. Crown attorney Rick Nathanson countered that Clements was only concerned with protecting the public. The issue is not with her beliefs¦but her breaking the law and interfering with people's rights, he said. He claimed that Clements was not attacking her religion and emphasized how the judge had said he had absolutely no problem with her point of view. While he conceded some of Clements' comments were inelegant and unfortunate, Nathanson said the judge was dealing with an emotionally charged issue. He also argued it was not improper of him to inquire of her as to whether Wagner would be a further risk to the community and said her increased sentence was proportional to what she had done. In his final submissions, Boushy noted it was important that justice be seen to be done in the case, as leading media outlets such as Sun TV and the National Post were covering it. Judge Ken Campbell said he would reserve judgement and provide a written decision soon. Meanwhile, Wagner is to appear in the Ontario Court of Justice at College Park on October 9 at 10 a.m. for a bail hearing regarding her latest charges of mischief and two counts of failing to comply with probation orders after her recent arrest at the Women's Care Clinic abortion site on Lawrence Avenue West in Toronto. She is incarcerated at the Vanier Centre for Women in Milton. The Crown has indicated it will oppose her release pending trial, no matter what. In a letter to a supporter from jail, Wagner said she has a lot of peace and is praying for the guidance of the Holy Spirit here. She said seven or eight inmates gather every morning for a Bible study and that may have resulted in her area of the jail being calmer than I’ve ever experienced. She told the story of a pregnant fellow inmate who began singing the hymn Amazing Grace and her baby started kicking up a storm her T-shirt was moving all over the place! She said the baby usually saves the gymnastics for night-time, but I guess she wanted to praise (God), too! William Watkin, West Virginia Judge Thursday, July 1th, 2010 West Virginia Judge, William Watkins is inducted into our Hall of Shame for going berserk on the bench, berating and threatening (with abuse of power) Rev. Arthur D. Hage in a divorce hearing. In listening to the video recording of the hearing, it is perfectly clear in our mind that Judge Watkins should be removed from the bench because of his anger issues and utterly unprofessional behavior that goes way beyond the pale. No matter what Rev. Hage has done, and as best as we can tell he merely expressed his First Amendment rights and talked to a reporter, Judge Watkins behavior disqualifies him, in our opinion, as an officer of justice. One source of the Judge’s anger is sourced in the Newspaper publishing a picture of his house, causing the Judge and his family to come under duress from some members of the public terrorizing his family. We completely understand that anger. However, Rev. Hage does not control the press. Even if Rev. Hage did control the press, the over-the-top anger of Judge Watkins, which is understandable if his family was under attack, the proper and judicial response for the judge would be to recuse himself, instead of humiliating himself in the way be behaved. After this hearing, Rev. Hage filed an ethics violation against the Judge, as was proper to do. Only after the ethics complaint did Judge Watkins recused himself from the case. This is something a professional would have done from the very beginning. Our concern, however, is not exclusive to this one judge, but to the growing lack of judicial decorum witness in many cases like this one. Justice cannot be served by Judges like this one, and more critically, outright miscarriage of justice is likely. Justice Ruth Bader Ginsburg Thursday, July 1th, 2010 U.S. Supreme Court Justice Ginsburg is inducted into our Hall of Shame for her support of eugenics and abortion. Recently Ginsburg stated, Over a generation of young women have grown up, understanding they can control their own reproductive capacity, and in fact their life’s destiny. We will never go back to the way it once was… Whatever the court may do, it’s only the poor women who will suffer. When people realize that, maybe they will have a different attitude. Her real reason for believing in the permanence of abortion was revealed by her one year ago when she admitted her real agenda in an interview with Emily Bazelon of the New York Times, Frankly I had thought that at the time Roe was decided, there was concern about population growth and particularly growth in populations that we don’t want to have too many of. This was the same motivation of Margaret Sanger, the Patron Demon of Planned Parenthood. Sanger wanted to reduce the population of undesirables, especially blacks. Abortion is not about women’s rights. It is about money, primarily, and secondarily about eugenics. It is evil on its face not only because it is murdering an innocent child, but because this is a murder-for-hire and it is an ideology of pseudo-genocide. Justice Ginsburg and other liberal Justices who support abortion are perverts, with Ginsburg the current matriarch of this perversion of murder of babies. German Courts and Government Thursday, July 1th, 2010 The German government is inducted into our Hall of Shame for the promotion of the Culture of Death. A German Court ruled that active and direct euthanasia (which is murder) is legal. Here the story:
German Court Legalizes Euthanasia By Hilary White BERLIN, June 25, 2010 (LifeSiteNews.com) In a surprise move, the German Federal Court of Justice has legalized direct euthanasia, ruling that an attempted direct euthanization of a comatose woman was not unlawful since she had given consent. The expressed wishes of the patient … justified not only the end of treatment via the withholding of further nourishment but also the active step of ending or preventing the treatment she no longer wanted, the court said. The ruling in the case of Erika K overturns a previous conviction for manslaughter of a lawyer who advised the daughter of a comatose woman in her 70s to cut her mother's feeding tube with a pair of scissors, after nursing home staff had refused to remove it. A lower court acquitted the daughter of killing her mother because she had mistakenly followed her lawyer’s advice. The lawyer, Wolfgang Putz, was convicted and given a nine month suspended sentence. The government prosecutor had been asking the court for a stronger sentence. Putz's lawyer had argued that the use of a gastric tube is forced treatment that the daughter had a right to terminate according to the known will of her mother. Although Chancellor Angela Merkel has previously stated that she opposes any form of assisted suicide, the decision was welcomed by her government. Justice Minister Sabine Leutheusser-Schnarrenberger said, In a difficult phase of life, wills by patients provide safety for patients, relatives, doctors and nurses. The will freely formulated by a human being must be respected in all circumstances of life. In countries that have already legalized euthanasia, such safeguards as living wills are often cited by euthanasia campaigners as means of avoiding abuse of power by doctors and nurses. Nevertheless, reports from Belgium and the Netherlands increasingly show that patients are regularly being killed without any form of consent. In May this year, a report published in the Canadian Medical Association Journal found that over 30% of reported euthanasia cases in one region of Belgium were carried out without the consent of the patient. In 2003, the Netherlands became the first country in the world after the downfall of the Nazi regime to legalize euthanasia. In the last two years, they have seen a sudden rise in euthanasia cases, with 2636 reported euthanasia deaths in 2009, a 13% increase from 2008. In 2005, one study estimated that cases of involuntary euthanasia, in which doctors do not follow the legal procedure to gain consent of the patient or family, account for about 550 deaths in the Netherlands each year. Dr. Els Borst, the former Dutch health minister and deputy prime minister who guided the country's euthanasia law through parliament, has lamented the increase in euthanasia cases and said that it has effectively destroyed the country's palliative care system. The issue of direct euthanasia of disabled patients is particularly sensitive in Germany, whose National Socialist regime carried out mass killings of patients in the years building up to the Second World War. In the so-called Aktion T-4 program, the government sanctioned the killing of thousands of orphans and mentally ill and disabled patients in the care of the state who were considered life unworthy of life. Many of the children faced death by starvation.
